The lawsuits pending against Mead Johnson and Abbot Laboratories (the manufacturers of Enfamil and Similac respectively) are based on two criteria:
1. Link to Disease
Multiple studies have linked cow milk-based formulas to higher risk of NEC among premature infants. These studies go as far back as 1990. Moreover, NEC has the potential to be a highly severe illness. In some cases, Infants diagnosed with NEC must be intubated or even have surgery to remove dead intestinal tissue. Those that go on to live may have lifelong digestive problems, among other health issues.
2. No Warnings Given
Despite all the currently existing research indicating a link between these baby formula substitutes and NEC, Mead Johnson and Abbot Laboratories are alleged to have failed to disclose this risk in any sort of warning labels or marketing for their products. In doing so they may have put countless children at risk as parents and care providers fed children these formulas, believing them to be perfectly safe.
